Privacy Policy

1. Definitions

• Platform – Alakh Realty mobile application and website.
• User – Any Builder, Seller, Buyer, Broker, Agent, or Third Party who uses the Platform.
• Property Lister / Seller – Any Builder, Developer, or Individual who lists a property.
• Buyer – Any person searching for property through the Platform.
• Lead – Any inquiry/contact generated via Alakh Realty (marketing, message, call, reference, or visit by Alakh Realty representative).

2. Scope of Service

• The Platform provides property listing, visibility, and marketing support.
• Alakh Realty is not responsible for ownership disputes, approvals, or legal compliance of properties.
• Alakh Realty is not responsible for misrepresentation or fraud by Sellers/Builders.
• If a property is marked “Verified”, documents are checked at submission.
• If a property is not verified, responsibility lies solely with the Seller/Builder.

3. Registration & Listing

• Properties can be listed with Free or Paid Registration.
• Builder Registration Fee: ₹25,000 (subject to future revision as per market conditions).
• Sellers can list properties with free or paid plans.
• “Verified” tag is given only upon proper document submission.

4. Brokerage Policy

• Residential & Commercial Properties
• Buyer: No Brokerage.
• Seller/Builder: Minimum 2% brokerage (or higher, if agreed).
• Brokerage is payable if:
  • Buyer visits property with Alakh Realty representative.
  • Buyer contacts Seller via Alakh Realty (message, call, reference).
  • Buyer sees property through Alakh Realty promotion.
  • Deal closes with any connection traceable to Alakh Realty.
• Land / Jameen Deals
• Brokerage: 1% or more chargeable from both Buyer and Seller.

5. Marketing & Promotion Charges

• Builders: ₹25,000 (deductible from first brokerage).
• Other Sellers: ₹15,000 or above (deductible from first brokerage).
• Charges are non-refundable but adjustable against first brokerage if deal closes via Alakh Realty.
• Charges may be revised in future and updated on the Platform.

6. Payment Terms

• All brokerage payable immediately after deal closure.
• Brokerage liability arises once Buyer & Seller connect via Alakh Realty.
• Circumventing brokerage is a violation and may result in legal action.

7. Financial Transactions (Present & Future)

• Currently, Alakh Realty does not handle online payments or deposits.
• All payments are directly between Buyer and Seller.
• Future services may include payment facilitation without guarantee.
• Alakh Realty will not be liable for disputes except as per Indian law.

8. Geographic Scope & RERA Compliance

• Services available across India.
• Builders must provide valid RERA registration where applicable.
• Compliance is not guaranteed unless property is marked verified.

9. User Responsibilities

• Sellers must provide correct ownership and legal documents.
• Buyers must conduct due diligence.
• All disputes are solely between Buyer & Seller.

10. Limitation of Liability

• Alakh Realty is only a marketing intermediary.
• Maximum liability equals the marketing/registration fee paid.

11. Prohibited Use

• Posting fake or misleading properties.
• Illegal or fraudulent use.
• Brokerage circumvention.

12. Termination of Service

• Listings violating terms may be suspended or deleted.

13. Modification of Terms

• Terms may be updated anytime without prior notice.
• Continued usage implies acceptance.

14. Jurisdiction

• All disputes subject to Ahmedabad, Gujarat jurisdiction.
• Governed by laws of India.
